Legal glitch could delay Housing Corp projects

Housing Corporation chief executive Jon Rouse has warned that some projects could face delays because of a legal oversight concerning its decision-making powers. Rouse said the problem was discovered as lawyers were going through a routine regulatory case. “We realised the problem that had arisen in the specific case went much further. It does mean that some changes will have to be made.” The Corporation’s lawyers found that the board does not have the power to delegate decisions to officers or sub-committees. Rouse said: “We will do our utmost to make sure it doesn’t affect current projects. But some decisions taken at officer level will have to be taken at board level.” Rouse said: “Not surprisingly media reports have overstated the case,” with reference to reports that most decisions taken over the last three months, and possibly the last 42 years, could be challenged. He added: “There are probably limited grounds for challenge on decisions made before the three-month time period for judicial reviews. And a lot of the most difficult decisions were taken by the board.”
