Q:I have recently purchased a site for redevelopment. My proposals involve excavating in relatively close proximity to neighbouring pre-existing buildings. What are my obligations?

If you intend to:-<p></p><p> * construct foundations for a new structure; or </p><p> * excavate land within three metres of a neighbouring pre-existing building where the proposed works will go deeper than the pre-existing buildings foundations; or</p><p> * construct foundations for a new building or dig excavations within six metres of a neighbouring pre-existing building where that work will cut a line drawn downwards at 45 degrees from the bottom of the neighbour&amp;’s foundation </p><p> Then the Party Wall Act 1996 requires you to inform the adjoining owner by serving a notice giving prescribed information and stating whether you propose to strengthen or safeguard the foundation of the neighbouring pre-existing building. If you start work without doing this in the proper way, the neighbour could seek redress through the courts.</p><p></p>
